Welcome to TeachTools. By using our service, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using TeachTools, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

TeachTools is a web-based platform that helps educators create worksheets, quizzes, lesson plans, rubrics, and other educational materials using AI-powered generation tools.

Service Features Include:

• AI-powered content generation (worksheets, quizzes, assessments, etc.)
• Template library and customization tools
• Content storage and organization
• Export and print capabilities
• Subscription management

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account. TeachTools is intended for educators, teachers, and school administrators.

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and up-to-date account information

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the service.

4. Acceptable Use

4.1 Permitted Use

TeachTools may be used to create educational materials for:

• Classroom instruction
• Homeschooling
• Tutoring and educational support
• Curriculum development
• Professional development

4.2 Prohibited Use

You may not use TeachTools to:

• Generate content that is illegal, harmful, defamatory, or discriminatory
• Create materials that violate intellectual property rights
• Resell or redistribute generated content as a standalone product
• Reverse-engineer, decompile, or attempt to extract source code
• Automate access to the service via bots or scripts (without written permission)
• Share your account credentials with others
• Upload malware, viruses, or malicious code
• Abuse or overload our systems

5. Subscription and Billing

5.1 Pricing

TeachTools offers a monthly subscription plan at $29/month. Pricing is subject to change with 30 days' notice.

5.2 Billing

• Subscriptions are billed monthly via Stripe
• Payment is due at the start of each billing cycle
• You authorize automatic renewal unless you cancel
• All fees are non-refundable except where required by law

5.3 Pause Anytime Policy

You can pause your subscription at any time from your account settings. When paused:

• You will not be billed for future months
• Your account and generated content remain accessible (read-only)
• You can resume your subscription at any time

5.4 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. You retain access to your account until the end of the paid period.

5.5 Failed Payments

If your payment method fails, we will attempt to contact you and retry billing. After 3 failed attempts, your account may be downgraded to read-only mode.

6. Content Ownership

6.1 Your Content

You own the content you generate using TeachTools. This includes worksheets, quizzes, lesson plans, and other materials.

6.2 License to TeachTools

By using the service, you grant TeachTools a limited, non-exclusive license to:

• Store and display your content within your account
• Process your content to provide the service
• Use anonymous, aggregated data to improve the service

We will not sell, share, or publicly display your content without your permission.

6.3 TeachTools Intellectual Property

TeachTools retains all rights to:

• The platform, software, and code
• Templates, design elements, and branding
• AI models and generation algorithms

7. AI-Generated Content Disclaimer

TeachTools uses AI (via OpenAI's API) to generate educational content. While we strive for accuracy and quality:

• AI-generated content is not perfect. You should review and edit all materials before use.
• Accuracy is not guaranteed. AI may produce factual errors, outdated information, or content that doesn't meet your specific needs.
• You are responsible for content quality. Always verify facts, check for age-appropriateness, and ensure alignment with your curriculum.

8. Privacy and Data Protection

Your privacy is important to us. Our data practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

• We do not sell your data
• AI-generated content is not used to train models
• Data is encrypted in transit and at rest
• We support FERPA compliance for educational data

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• TeachTools is provided "AS IS" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure service
• We are not liable for indirect, incidental, or consequential damages
• Our total liability to you shall not exceed the amount you paid in the past 12 months

10. Indemnification

You agree to indemnify and hold harmless TeachTools from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the service
• Your violation of any law or third-party rights
• Content you generate using the platform

11. Service Availability

We strive to maintain high availability but do not guarantee:

• 100% uptime (scheduled maintenance may occur)
• Compatibility with all devices or browsers
• Preservation of data if you violate these Terms

We will make reasonable efforts to notify users of scheduled downtime.

12. Third-Party Services

TeachTools integrates with third-party services (OpenAI, Stripe). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service interruptions or changes.

13. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue features at any time
• Update pricing with 30 days' notice
• Change these Terms (we will notify you of significant changes)

Continued use after changes constitutes acceptance of the new Terms.

14. Termination

14.1 By You

You may cancel your account at any time from your account settings.

14.2 By TeachTools

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the service or harm other users
• Fail to pay subscription fees

Upon termination, you lose access to your account and generated content (subject to applicable data retention laws).

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

15.2 Arbitration

Any disputes arising from these Terms or your use of TeachTools shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class-action lawsuits.

15.3 Informal Resolution

Before initiating arbitration, please contact us at support@teachtools.co to attempt to resolve the issue informally.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TeachTools.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

16.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign these Terms. TeachTools may assign these Terms to a successor or affiliate.
